Electronic Information and Transactions Law of 2008 (EIT)

Online safety is primarily regulated by the EIT and is supervised by the Ministry of Communications and Digital Affairs (MOCD).

   Scope of online safety measure(s)

Any party who provides, manages, operates, and/or uses electronic systems. 


   Online harms addressed

EIT regulates prohibited content (ie, amoral content, gambling, defamation, extortion, hoax, hate speech and threats), and harmful content posing danger to individual and public safety.


   Territorial scope

The EIT applies to any party on or offshore where such party has a legal impact in Indonesia or harms the interests of Indonesia.


   Penalties and enforcement

Wide enforcement powers including: terminating access to prohibited and harmful content; administrative sanctions ranging from written warnings, fines and temporary suspensions; and criminal sanctions including fines and imprisonment.
