The TPP is the largest mega-regional trade and investment deal made, encompassing approximately 40% of global GDP and worth approximately USD 28 trillion. Once ratified, the TPP will have extensive global reach, embracing the United States, the Asia-Pacific and South America. As companies take advantage of the access to new markets enabled by the TPP, it will be necessary for companies to manage their investment risks and for states to manage their exposure to liability for breaches of investors' rights. Thus, the Investor-State Dispute Settlement (ISDS) provisions in the TPP are of great importance to potential investors and governments alike. The ISDS provisions in the TPP are complex. They establish carefully circumscribed standards of protection available to foreign investors making investments in TPP countries. They also provide for international arbitration, with procedures allowing for public participation in the arbitral process.
