Welcome to the tenth issue of Inside Arbitration.
We are delighted to share with you the latest, new look issue of this publication from Herbert Smith Freehills' Global Arbitration Practice. This issue contains even more interactive content, including videos and podcasts to accompany the articles.
Following the launch of the LCIA Rules 2020 earlier this month, this issue reviews the changes and highlights the main developments.
With input from across our arbitration practice, we also look at how the COVID-19 pandemic has affected arbitration, as well as sharing knowledge and insight about the markets and industries in which our clients operate and offering the personal perspectives of our international arbitration partners.
In this issue:
- Craig Tevendale and Andrew Cannon analyse the revisions and highlight the more significant changes in the recently released LCIA Rules 2020. We have also produced some helpful resources on the updated Rules, including a podcast and post on our Arbitration Notes blog.
- The arbitration community has responded to the COVID-19 pandemic by moving up a gear to answer the need for virtual proceedings. Paula Hodges QC, Patricia Nacimiento and Vanessa Naish have produced an article looking at the digitalisation of arbitration and virtual hearings in a post COVID-19 world, and there is an accompanying podcast where Patricia and Vanessa are joined by Craig Tevendale and Kathryn Sanger to discuss the developments.
- While investors recognise that governments have had to make difficult decisions, there are concerns that some of the steps taken may breach investment treaty protections. Andrew Cannon, Christian Leathley and Hannah Ambrose look at the likely profile of treaty claims in the context of the pandemic in their article and podcast.
- Alexei Panich, Sergei Eremin, Polina Podoplelova and Olga Dementyeva look at the impact on arbitrations of new legislation giving the Russian courts exclusive jurisdiction over disputes involving Russian individuals and companies subject to sanctions.
- Emma Schaafsma and Elizabeth Kantor explore the role of experts in international arbitration and discuss how best to manage expert evidence.
- Our two newly promoted partners Chad Catterwell and Gitta Satryani give an insight into their areas of practice and personal expectations for arbitration in their respective regions in spotlight interviews.
- The new “Did you know” page takes a look at our Sustainability in Arbitration initiative.
