Today we have launched the ninth edition of our dispute resolution guide for the Asian-Pacific region.  The Guide aims to provide a concise and accessible overview of some of the practical issues involving both litigation and arbitration across the region.  The new edition has been revised and updated to take into account developments across key jurisdictions and to cover additional jurisdictions in the Asia-Pacific region (Australia and New Zealand) and Asia (Myanmar).

The Guide will be of particular interest to individuals and businesses engaged in cross-border activities across the region. There is always a risk that cross-border business activities will give rise to disputes, resulting in either litigation or arbitration in a jurisdiction with which at least one of the parties will be unfamiliar.  The Guide aims to provide answers to some of the basic questions a party unfamiliar with a particular jurisdiction will have when facing the prospect of having to engage in a dispute resolution process in such a jurisdiction.  There are some significant differences between the jurisdictions covered in this Guide.  Notable examples are the rules relating to limitation periods, the requirement to disclose documents and other evidence prior to trial, the ability of states and state entities to claim immunity from suit and the enforcement of foreign judgments or arbitral awards.  These are amongst a wide range of issues covered in the Guide.

The Guide is due to be mailed out to clients on our disputes mailing list in the course of next month.  If you do not receive a copy by the end of next month or would like additional copies of the Guide  please email asia.publications@hsf.com or Pamela Kiesselbach.

You can find a full updated list of all Asia and Asia Pacific guides on the Guides page of Asia Disputes Notes.
