The Sex Discrimination (Amendment) Ordinance 2014—Ordinance No. 19 of 2014 came into force on 12 December 2014. The amended ordinance can be found here. The amended Ordinance provides that it is unlawful for anyone to sexually harass a woman who provides, or will provide, goods, facilities or services.  The amended Ordinance also limits its jurisdictional scope. It does not apply to sexual harassment outside Hong Kong. However, sexual harassment on i) a ship registered in Hong Kong, or ii) an aircraft or dynamically supported craft registered in Hong Kong falls within the jurisdiction of the amended Ordinance.

We previously reported that the Contracts (Rights of Third Parties) Bill was to be introduced into the Legislative Council in March 2014. The Ordinance's gazette date is 5 December 2014 and can be found here. The Ordinance will only come into operation, however, when the Secretary for Justice publishes a notice in the Gazette. This is expected to be in December 2015. Our previous e-bulletin summarising the Ordinance (the terms of which remain the same), can be found here.
