The Courts and Tribunals Judiciary has published two speeches on litigating financial disputes by Sir Geoffrey Vos, Chancellor of the High Court, and Sir Nicholas Hamblen, Lord Justice of Appeal.
In his speech, Sir Geoffrey discusses the effect of Brexit on financial services disputes in London which he considers will not be as dramatic as some have suggested. Sir Geoffrey examines some of the issues that underlie a choice of law and jurisdiction, before considering the position of English law and UK jurisdiction after Brexit; and discusses the future, with particular reference to the developments in FinTech, LawTech and RegTech.
In his speech, Sir Nicholas focusses on the Financial List. In particular, he considers the knowledge and experience of the judges, procedure, progress so far, and the potential impact of Brexit. Sir Nicholas concludes that the Financial List is flourishing and its work should not be substantially affected by Brexit.
