The updated Migration section of our Beyond Brexit Legal Guide is now available.

This provides a useful overview, including:

  • during the transition period, EU citizens can continue to live, work and study in the UK. EU citizens wishing to remain in the UK after the transition period need to apply for settled or pre-settled status by 30 June 2021;
  • after the transition period, the free movement of people between the UK and the EU will end and the UK will put in place a new points-based immigration system to come into effect on 1 January 2021;
  • UK and EU intend to allow UK and EU citizens to enjoy visa-free travel in EU Member States (except Ireland) and Schengen Associated Countries (Iceland, Liechtenstein, Norway, Switzerland) and the UK, respectively, for short-stay visits for up to 90 days in any 180-day period after the transition period. As Ireland does not participate in the Schengen acquis on visas, the bilateral travel arrangement between the UK and Ireland is not affected;
  • after the transition period, unless different arrangements are agreed, mutual recognition of professional qualifications between the UK and the EU will cease. In a result, professionals seeking recognition will no longer be able to rely on EU rules and will need to comply with the relevant domestic regime in each country.
