Construction and Infrastructure partners David Nitek and Nicholas Downing have once again authored an expert analysis chapter in the eighth edition of The International Comparative Legal Guide to: Construction & Engineering Law 2021 as contributing editors of the edition.
Their chapter "Waking Watch: Fire and Building Safety After Grenfell" analyses the main English cases which have followed Grenfell, recent changes in the approach taken by parties to the negotiation of construction contracts on UK developments. They look at how various insurances may be relevant in situations where there has been a breach of regulations and provide a comparative overview of builders’ liability in respect of fire/building safety under the French/civil law regime.
As with previous editions, this guide also provides insights into how different legal systems approach the questions that are commonly encountered on construction and engineering projects, covering 21 jurisdictions in the form of a Q&A style chapter.
