Note: on 7 February 2023 it was announced that the Investment Screening Unit responsible for reviewing transactions under the National Security and Investment regime would be moved to sit under the Chancellor of the Duchy of Lancaster in the Cabinet Office, and that the Chancellor of the Duchy of Lancaster/Secretary of State in the Cabinet Office would replace the Secretary of State for the Department of Business, Energy and Industrial Strategy as the relevant Secretary of State for decision-making under the regime. This does not affect the substantive regime or any of the processes described in this webinar or the accompanying briefing.
On 3 November 2021 Herbert Smith Freehills LLP hosted a webinar, with speakers from the Department for Business, Energy and Industrial Strategy (BEIS), on the UK's new National Security and Investment regime. The new regime will overhaul the ability of the UK Government to review transactions on national security grounds, and potentially require remedies to allow them to proceed or even prohibit them. We were delighted to be joined by Chris Blairs, Deputy Director at the new Investment Security Unit (ISU), and Daniel McCarthy, Senior Policy Advisor at the ISU, who were able to provide useful insights on some of the more frequently asked questions we are discussing with clients and clarify some of the more technical points in the legislation.
