On 20 June 2019, the US Senate confirmed Keith Krach as the Under Secretary of State for Economic Growth, Energy, and the Environment. As part of that role, Krach will serve as the permanent Ombudsman for the EU-US Privacy Shield agreement.
The EU-US Privacy Shield is a framework that regulates transatlantic exchanges of personal data between the EU and US, to ensure data protection and privacy compliance when transmitting personal data from EU entities to the US and to enable US companies to retrieve personal data more easily from the EU under privacy laws meant to protect EU citizens. As permanent Ombudsman, Krach will oversee complaints and requests under the Privacy Shield agreement. Krach's appointment is viewed as a step by US officials to address European Commission demands for a permanent ombudsman mechanism to address Privacy Shield complaints and demonstrate that the US is committed to Privacy Shield compliance.
