Herbert Smith Freehills hosted its eleventh annual Corporate Crime and Investigations conference in London on 20 June 2024, with the overall theme "Corporate fraud – navigating the changing landscape".
The conference was split into two interactive panel sessions. The first panel session addressed fraud liability and risk mitigation, and included a discussion of the new failure to prevent fraud offence, key risk areas, and the likely approach to enforcement.
The second panel session focused on fraud response and recovery, where Herbert Smith Freehills experts from across its international network discussed how a company could respond if it has been a victim of fraud, including criminal and civil options for recovery, and the pros and cons of pursuing a private prosecution.
