In contrast to ordinary public law principles, where there is a high threshold before the court will intervene, procurement law involves a much more searching approach to review. Exacting standards are applied to the conduct of procurement processes, and if you are participating as a bidder there is greater scope to challenge a decision.
We are pleased to share with you a new booklet on procurement disputes which the Public Law team at Herbert Smith Freehills have put together. It can be viewed by clicking the link below. The booklet is aimed principally at corporates who bid in the UK for large Government/public sector contracts as well as UK bodies who run large procurement processes. We have sought to collate a number of significant cases from recent years in order to provide an overview of the current procurement regime for running evaluation processes and the issues which arise in High Court litigation when procurement processes are challenged.
