On Thursday 25 February experts from across our international network, covering a variety of practices and sectors (including competition, data, media and digital technology), took part in a live panel session to discuss the proposed Digital Services Act (“DSA”) and Digital Markets Act (“DMA”).

The DSA and DMA legislative package was published on 15 December 2020 by the European Commission. The package is a turning point for regulation of the online environment both within the European Union and beyond. It sets out a raft of new obligations on digital service providers (as well as reinforcing existing obligations) and introduces significant fines for non-compliance, pushing greater onus on the major tech companies to take responsibility for their role in relation to the internet and the digital ecosystem at large.

Members of our Digital TMT & Data team (Hayley Brady, Miriam Everett, James Balfour and Jeremy Purton) joined with Competition, Regulatory and Trade experts from our Brussels, London and Düsseldorf offices (Kyriakos Fountoukakos, Peter Rowland, Veronica Roberts, Marcel Nuys and Anne Eckenroth) for the live panel session.

The discussion focused on:

  • the contextual background to the European Commission's proposals and likely next steps as the legislation continues its journey through the legislation procedures;
  • what the regulatory package is likely to mean for stakeholders at all levels of the digital value chain; and
  • some of the related developments at a national level in respect of the UK and Germany.

This live panel session will kick-start a series of sessions and content on the DSA and DMA, with future content focussing in detail on further aspects of the legislative package. A live poll carried out as part of the session highlighted that there was particular interest in further content on (i) liability of online intermediaries for illegal and harmful content; (ii) rules in relation to advertising and associated data protection considerations; and (iii) risk management and data sharing obligations for very large platforms.
