Libby is a commercial litigator with experience in regulatory matters and major commercial disputes, including class actions. 

Libby has assisted numerous ASX listed clients facing securities class actions in both State and Federal Courts, including acting on proceedings which have both proceeded to judgment and resolved without the need for a trial. Libby also has substantial experience representing class action defendants in interactions with insurers.

Libby’s experience also includes assisting clients with regulatory investigations commenced under both State and Commonwealth legislation, and major commercial disputes in the construction and mining sectors.  

Libby has extensively considered settlements in class actions within Australia and contributed to the revisions for the third edition of Class Actions in Australia (Third Edition, Thomson Reuters, 2022). 

Background

Libby graduated from Murdoch University with a Bachelor of Laws and also holds a Master of Laws (Distinction) from the University of Western Australia. Libby’s experience includes an Associateship at the Supreme Court of Western Australia. 

Libby is admitted to practice in Western Australia and the High Court of Australia.

  • An Australian mining company in its successful defence of a declaration proceeding in the Supreme Court of Western Australia concerning the proper location of granted mining tenure under the Mining Act 1904 (WA) (repealed). 
  • Wellard Limited in its defence of a shareholder class action in relation to alleged non-disclosure concerning its FY16 earnings guidance. 
  • A West Australian mining company in relation to regulatory actions concerning both Commonwealth and State environmental legislation.  
  • Sims Limited in defending a shareholder class action in relation to alleged non-disclosure concerning its FY15 and FY16 earnings guidance.
  • Iluka Resources Ltd in defending a shareholder class action in relation to alleged non-disclosure concerning its 2012 sales guidance.
