The EU's new General Data Protection Regulation entered into force in May 2016 and will be applicable in Spain in May 2018. During that interim period of legislative limbo, controllers and processors of the personal data of economic agents must lay the groundwork and adopt all the measures necessary to be in a position to comply with the provisions of the new EU regulation by the time it enters into force.
The new Regulation revolves around two elements that will be of special relevance for data controllers: on the one hand, the accountability principle, which establishes the need for companies to apply appropriate technical and organisational measures to guarantee the protection of personal data and, on the other, what is called risk focus, according to which companies must evaluate the real risk that their actions will have on their clients' personal data.
