Trustees and data: responsibilities and risks

With the implementation of the EU's General Data Protection Regulation (GDPR), there has been a renewed focus on how organisations manage and use personal data. This topic gives rise to specific issues for trustees. For example, they will frequently hold personal data in relation to beneficiaries and may find that their obligations to provide beneficiaries with access to that data do not fit easily with common law rules on the confidentiality of trust documents.

In this webinar, with a particular focus on the current law in Hong Kong, England and the EU more broadly, solicitors from Herbert Smith Freehills' specialist trusts and data protection groups discussed some of the specific issues that arise for trustees. As people are becoming increasingly aware, data protection rules have wide ranging cross jurisdictional effect and the sanctions for non-compliance can be very significant.  The webinar will covered :
