Ein Kartellverfahren, das sich im Schwerpunkt der Bedeutung von Daten widmet, fehlte der EU-Kommission bislang. Vor wenigen Tagen eröffnete die Kommission allerdings ein Verfahren gegen Insurance Ireland, eine Vereinigung mehrerer in Irland tätiger Versicherer, die gemeinsam ein Datenpoolsystem geschaffen haben. Unter kartellrechtlichen Gesichtspunkten könnte Insurance Ireland nach Auffassung der Kommission dazu verpflichtet sein, anderen Unternehmen Zugang zu diesen Daten zu gewähren. The EU Commission has so far not conducted an antitrust proceeding focused on the importance of data. A few days ago, however, the Commission opened formal proceedings against Insurance Ireland, an association of insurance companies that administers a database to which its members contribute relevant data. The Commission has indicated that the terms of access to this database might infringe antitrust law as they could prevent newcomers from accessing the datapool.
