Las medidas cautelares no solo tienen el mismo nivel de protección constitucional y legal que la pretensión principal del proceso, sino que además muchas veces son el extremo más importante de éste. Muchos procesos se deciden en el momento de adoptarse medidas cautelares, que a veces son más gravosas que la sentencia final, y abren en ocasiones escenarios de negociación que permiten una más rápida resolución del litigio.

Interim measures not only rank, from a constitutional and legal standpoint, at the same level as the main proceedings; they are often the most significant aspect of the proceedings themselves. Many proceedings are decided when interim measures are awarded, which are frequently more burdensome than the final judgment and can also open the door to negotiations and a swifter conclusion to the dispute.
