The Joint Contracts Tribunal (JCT) has been publishing new editions of its contracts throughout 2024. Earlier this year, we examined the terms of the first new contract that was published; the JCT Design and Build Contract. JCT has now also published the revised version of its Major Project Construction Contract.
In line with the JCT's other 2024 contracts, the amendments do not seek to re-write the JCT Major Project Construction Contract terms. However, amendments have been made to the risk events (including in relation to epidemics, statutory powers and the publication of guidance) which mean that more risk is shared between the parties than in the previous edition of the Major Project Construction Contract. Amendments have been made to reflect new legislation and recent case law on payments under the Housing Grants, Construction and Regeneration Act 1996. The contract also places greater emphasis on sustainability, collaboration, and resolution of disputes, by moving previously optional provisions into the main terms.
