The government published the consultation "Proposed reforms to the National Planning Policy Framework and other changes to the planning system" on 30 July 2024. The consultation closes next week on 24 September 2024. It implements many of the government's manifesto pledges made during the 2024 general election. Everyone with an interest in development in England should consider responding.
The consultation asks for views and feedback regarding proposals which will impact both the Town and Country Planning Act and NSIP consenting regimes. Proposed reforms include making it easier to build infrastructure which is "necessary to grow the economy" (laboratories, gigafactories, digital infrastructure and freight and logistics) and changes to the thresholds for ground solar and onshore wind projects. In addition, the government seeks views on increasing funding and capacity of council teams including by allowing LPAs to charge fees for their work in relation to development consent applications. For a brief overview of what else the consultation covers, see our blog post on Real Estate Development Notes here.
The consultation asks 106 questions across both the TCPA and NSIP regimes. We've therefore prepared a detailed briefing to help our clients decide how to respond. This analyses the consultation proposals and discusses what else we have learned about other proposed changes to the planning system in England. If you would like a copy, please contact us.
