Josh Kain
Josh is a Senior Associate in our Technology team in Melbourne.
Josh's core practice involves advising on structuring, negotiating, documenting and implementing a broad range of transactions, including in relation to technology and IT procurement, large-scale digital infrastructure projects, intellectual property and licensing, commercialisation contracts, and major services arrangements (including in respect of outsourcing projects). Josh also supports organisations in understanding and complying with their cyber, privacy and other related regulatory obligations (including under the Security of Critical Infrastructure Act 2018 (Cth)), particularly in the context of responding to cyber incidents.
Background
Josh graduated from Murdoch University in Western Australia with a Bachelor of Laws (with distinction) and Bachelor of Business (International Business). Josh spent five years practising in our Perth office before transferring to Melbourne in 2024.
Josh is involved in a number of the firm's community initiatives and pro bono projects (including advising the Aboriginal Art Centre Hub Western Australia, Anglicare WA, Community Arts Network, Foodbank, National Breast Cancer Foundation, Ronald McDonald House and the Plastic Free Foundation). He served on the Western Australian Football Commission's Community Football Tribunal in 2022 and 2023.

- advising the Western Australian Land Information Authority on the contracting arrangements for a project to replace its current land valuation system with an Al¬assisted cloud-based solution
- advising an international mining company on its response to a significant cyber security incident, advising on all aspects of the organisation’s response including in relation to compliance with regulatory obligations, stakeholder and personnel management and the broader incident investigation process
- advising the Department of Foreign Affairs and Trade on the deployment of the transformational Tuvalu Subsea Cable System in partnership with Google and the Government of Tuvalu
- advising Mitsui E&P Australia and its 50 per cent joint venture partner, Beach Energy, in connection with the licensing and data security implications of the voluntary administration of Clough, the contractor responsible for the construction of the joint venture's Waitsia Stage 2 gas project
- advising a number of clients in relation to the commercialisation of emerging technologies (including in the energy, agricultural and ammunitions industries)
