The Bribery Act 2010 will come into force on 1 July 2011. The Ministry of Justice has now confirmed this date and published its guidance on what amounts to "adequate procedures" to prevent employees and other associated persons paying bribes (which provide companies with a defence to the new offence of failure to prevent bribery by associated persons). The Serious Fraud Office and Director of Public Prosecutions have also published their joint guidance for prosecutors on when to commence prosecutions under the Act.
