On 10 November 2024, the State Council announced the decision to amend the Regulation on Public Holidays for National Annual Festivals and Memorial Days ("Holiday Regulation"), effective from 1 January 2025. Below is a summary of the key points of this amendment.

After the amendment comes into force on 1 January 2025, the total number of public holidays each year will be increased from 11 days to 13 days. One additional day will be added to both the Spring Festival and Labour Day, making the Spring Festival 4 days (Chinese New Year's Eve and the first three days of the Lunar New Year) and Labour Day 2 days (1 – 2 May).

202511日起,即《节假日办法》修订生效后,每年的法定节假日总天数将由11天增加为13天。春节和劳动节各增加一天,即春节变为4天(农历除夕、正月初一至初三),劳动节变为2天(51日、2日)。

Additionally, the amended Holiday Regulation includes a new provision: "Around public holidays, employers may reasonably arrange collective leave or compensatory time off for their employees through the implementation of paid annual leave policies, to form longer holidays in practice. Except in rare special circumstances, the duration of continuous work before and after public holidays generally does not exceed six days."

此外,《节假日办法》还新增了一条规定:“全体公民放假的假日,可合理安排统一放假调休,结合落实带薪年休假等制度,实际形成较长假期。除个别特殊情形外,法定节假日假期前后连续工作一般不超过6天。”

Impact on Employment Management

对雇佣管理的影响

The increase in public holidays could slightly raise employers' employment costs. Under the Labour Law, employers are required to pay regular salary to employees during public holidays. Employees who are arranged or required by their employers to work on a public holiday are entitled to overtime payable at 300% of the employee's daily salary.

随着法定节假日天数的增加,用人单位的雇佣成本可能会些许增加。根据劳动法,法定节假日期间,用人单位应当向员工支付工资。如果用人单位在法定节假日期间安排员工工作的,应当按照日薪300%的标准支付工资。

However, the increased number of public holidays will not affect the number of paid days per month  (21.75 days), which is typically used to calculate employees' daily salary, with the formula: daily salary = monthly salary / 21.75.

不过,法定节假日的变化不会对月计薪天数(21.75天)造成影响。月计薪天数一般用于计算员工的日工资,公式为:日工资=月工资/21.75
