Dynamic change for merger control regimes 

There have been a number of important developments since the last edition of this Guide was published in 2022, including significant reforms on existing regimes such as China's long-awaited update of notification thresholds and Indonesia's introduction of a "dual nexus requirement". In addition, Cambodia's merger control regime is now underway, and the introduction of a cross-sector merger control regime remains a hot topic in Malaysia. 

Sustainable collaboration guidelines and ESG regulation

Increasingly, we are seeing competition authorities in Asia-Pacific regulating environmental, social and governance (ESG) related collaboration and marketing. Many authorities in the region have published guidelines on the acceptable limits of ESG-focused collaboration as well on the risks of greenwashing. 

Digital market under scrutiny

For several years now, regulators around the world have had to strike a balance between regulating the rapidly evolving world of tech and allowing innovation in this section to flourish – authorities in Asia Pacific are no different. It is no surprise then that digital markets remain a key enforcement area for many competition authorities in the region.
